			<content:encoded><![CDATA[<p>Did you bill with the –AT modifier and Medicare approved chiropractor dx codes?  If not contact Blue Shield explain your error and have the claim refunded and re-bill with the correct modifier and dx codes.  Once you receive the EOB for the corrected claim send in an appeal to Medicare and they may pay for the $25.00 copay.   If you did all of that and obtained a signed ABN start at the beginning and place the correct modifier on the BS claim and Medicare should apply the amount to the patient.  If the care is not  necessary then there isn’t much you really can do.  I would not charge the patient unless you have a Medicare EOB that states you can.  I would not want to deal with the ramifications that Medicare can cause you if you bill the patient when you were “told” not to for chiropractic visits.</p>

My name is Michelle and I have been working as a CA for 2 years now in Marietta,<br />
GA. I used to work in the healthcare field but once I discovered chiropractic in<br />
2006, I was never able to view my job in healthcare the same way. I fell head<br />
over heels in love with chiropractic! My husband even decided to become a<br />
chiropractor after working as an engineer for 5 years. He is currently in the DC<br />
program at Life University. He has 1 year left of schooling and then we plan on<br />
moving to New Hampshire where we will open our own office right away. I am so<br />
excited for our future office and looking so forward to being the office<br />
manager. I am very interested in learning more about running an office, the<br />
legalities, and different ways of doing things. We are planning on being a cash<br />
only practice so I am always looking for ideas on how to do that best also. I<br />
have already learned a lot<br />

<p>Here&#8217;s a question:  What&#8217;s up with Cigna contracting ASHP for out of<br />
network providers to prove medical necessity?</p>
<p>We are not contracted with insurance companies, but do bill for our<br />
patients.  All the sudden, we&#8217;re being asked to jump through the ASHP<br />
hoops. Same paperwork I had to do when we WERE contracted.</p>
<p>Am I obligated to do this for out of network claims?  Do we really have<br />
to do all this paperwork?  Can we charge for it?</p>

			<content:encoded><![CDATA[<p>MEMORANDUM OPINION AND ORDERMATTHEW F. KENNELLY, District Judge.The<br />
plaintiffs in this case are chiropractic physicians, an occupational<br />
therapist, and a clinical social worker/trauma specialist who have<br />
provided services to members of health care plans insured or<br />
administered by the defendants; professional associations whose members<br />
are chiropractic physicians; a residential treatment facility; and a<br />
subscriber to a health care plan.1<br />
The defendants are Blue Cross and Blue Shield of America (BCBSA) and<br />
individual Blue Cross and Blue Shield entities (BCBS entities). BCBSA is<br />
a national umbrella organization that facilitates the activities of<br />
individual BCBS entities. Individual BCBS entities insure and administer<br />
health care plans to Blue Cross and Blue Shield customers (BCBS<br />
insureds) in various regions.Plaintiffs<br />
allege that defendants improperly took money belonging to plaintiffs.<br />
They allege that defendants would initially reimburse the provider<br />
plaintiffs for medical services they provided to BCBS insureds. Sometime<br />
afterward, plaintiffs allege, defendants would make a false or<br />
fraudulent determination that the payments had been in error. Defendants<br />
then would demand that individual plaintiffs repay the supposedly<br />
overpaid amounts immediately. If plaintiffs refused to return the<br />
payments, defendants would forcibly recoup the amounts they sought by<br />
withholding payment on other, unrelated claims for services plaintiffs<br />
provided to other BCBS insureds. The subscriber plaintiff, Katherine<br />
Hopkins, alleges that she was held liable for portions of a bill for<br />
services she received at Miami Valley Hospital after her insurer, Anthem<br />
Ohio, demanded recoupment from the chiropractic provider who treated<br />
her.Plaintiffs<br />
allege further that when defendants made these repayment demands, they<br />
typically did not provide adequate information regarding available<br />
review procedures. Plaintiffs allege that defendants sometimes failed to<br />
offer any appeal process at all. When an appeal process was available,<br />
plaintiffs allege, defendants refused to provide details about which<br />
patients, claims, and plans were claimed to be the subject of<br />
overpayment or &#8220;effectively ignored&#8221; plaintiffs&#8217; appeals. Fourth Am.<br />
Compl. ¶ 18. Plaintiffs contend that this conduct deprived them of their<br />
right to a &#8220;full and fair review&#8221; under section 503 of ERISA, 29 U.S.C.<br />
§ 1133.Plaintiffs<br />
sue on behalf of themselves and, in the case of association plaintiffs,<br />
on behalf of their members. They also sue on behalf of a putative class<br />
of similarly-situated individual plaintiffs.Plaintiffs<br />
filed their first amended complaint on November 16, 2009. In that<br />
complaint, plaintiffs alleged that defendants&#8217; actions violated the<br />
Racketeer Influenced and Corrupt Organizations Act (RICO), the Employee<br />
Retirement Income Security Act (ERISA), and Florida law. On May 17,<br />
2010, the Court granted a motion by defendants to dismiss the RICO<br />
claims for failure to state a claim. Pennsylvania Chiropractic Ass&#8217;n v. Blue Cross Blue Shield Ass&#8217;n, No. 09 C 5619, 2010 WL 1979569 (N.D. Ill. May 17, 2010).</p>

When chiropractor patients say something I put the blame to the insurance saying I can be fined or the insurance can drop me ect ect. Unless there is a hardship we have a contract that the patients signs saying about the hardship we keep on file both blue cross and medicare have told me (also get it in writing from them) that hardship case are allowed. When patients call I remind them about the deductible I try to collect everything on date of service but I will bill patient or allow payments as well. I do not divide the deductible I put the actual approved amount from the carrier.</p>

We usually make payment arrangements with the patient on their first visit of the year and divide the deductible into 5-10 payments that are spread out for the first 5-10 visits but we always have cases where the patient meets deductible in 2 visits and stops making payments. Your practice can choose if they want to do extended payment plans which only cost the provider 5% of the total. you can set a minimum of what the patient has to spend (ours is $300) The best part for the provider is the amount is auto deposited into his/her acct minus the interest (highest is 13.5% but you don&#8217;t have to offer that one) and then you pretty much wipe your hands clean of it ~ we get the money, alot of times the patient gets interest free and if they have any problems paying their bill they deal with GM Moneybank collections&#8230;not us <img src='http://www.backpainreliefclinics.com/wp-includes/images/smilies/icon_smile.gif' alt=':)' class='wp-smiley' />  everyone is happy, happy! Oh and another thing that is nice is not everyone can get approved for a credit card, but Carecredit is alot more lenient.</p>
<p>Thank you for your input, I&#8217;m not trying to say they are the best option, I&#8217;m still trying to figure it out, I&#8217;m just stating how I see it right now. Also, the main reason we got involved with them wasn&#8217;t for our chiropractic care, but we offer microcurrent facial/body sculpting, which insurance doesn&#8217;t cover &amp; yes some people do use their credit cards, but still sometime the interest free is a big selling point.</p>

<p>We looked into it but I don&#8217;t understand what the incentive is for us or the patient? Most patients use their own credit cards that they can rack up their points.<br />
The doctor also has to pay carecredit to use their service, use their credit card machine or process the payment online and the percentage rate is not great.</p>

2012 Date-of-Service Claims for Services Paid Under the 2012 Medicare<br />
Physician Fee Schedule</p>

<p>The negative update under current law for the 2012 Medicare Physician<br />
Fee Schedule is scheduled to take effect on Sun Jan 1, 2012, eight<br />
business days from today. Consequently, as on numerous occasions in<br />
the past, CMS will instruct its Medicare claims administration<br />
contractors to hold claims containing 2012 services paid under the<br />
Medicare Physician Fee Schedule for the first 10 business days of<br />
January 2012 (i.e., Sun Jan 1 through Tue Jan 17). The hold should<br />
have minimal impact on provider cash flow because, under current law,<br />
clean electronic claims are not paid sooner than 14 calendar days (29<br />
days for paper claims) after the date of receipt.</p>
<p>Medicare Physician Fee Schedule claims for services rendered on or<br />
before Sat Dec 31 are unaffected by the 2012 claims hold and will be<br />
processed and paid under normal procedures and time frames.</p>
<p>The Administration is disappointed that Congress has failed to pass a<br />
solution to eliminate the sustainable growth rate (SGR) formula-driven<br />
cuts, and has put payments for health care for Medicare beneficiaries<br />
at risk. We continue to urge Congress to take action to ensure these<br />
cuts do not take effect.</p>
<p>CMS will notify you on or before Wed Jan 11, 2012, with more<br />
information about the status of Congressional action to avert the<br />
negative update and next steps regarding the claims hold.</p>
